This page, our policies and other documents which have been made reference to, reflects the terms and conditions (‘the ToU’) which must be adhered to while browsing our Website whether as a visitor, Customer or a potential Customer. Please read the ToU carefully prior to placing an order from the Platform. By using our Platform, you agree to accept and adhere to the ToU. Do not access to our Platform if you are not agreeable to any of the ToU. The ToU are subject to changes from time to time and are applicable to all visitors, Customers or potential customers.

1.0 ELIGIBILITY

1.1        To place an Order with SPRAY AND SHINE, you should be at least 18 years old or you may obtain assistance from your parent/guardian.

2.0 LIMITATION OF LIABILITY

2.1       SPRAY AND SHINE shall not be liable to any party for any unavailability or inoperability of the links, technical malfunction, replacement cost, computer error, corruption or loss of information or other injury or damage or disruption arising while browsing our Website. This is inclusive of other direct, indirect, incidental, special, consequential or punitive damages.

 

3.0 ACCEPTABLE USE

3.1        You shall use our site only for lawful purposes. You are strictly prohibited from using our site for the following purposes:-

    • In any way that breaches any applicable local, national or international law or regulation;
    • In any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect;

3.2       Any material which you contribute to our site must:-

    • Be genuinely held (where it states opinions); and
    • Comply with applicable law in India and in any country from which they are posted.

3.3       You indemnify us for any breach of Clause 3.1 or Clause 3.2.

4.0 INDEMNITY

4.1       You accept to indemnify SPRAY AND SHINE, its directors, employees and affiliates, from any third party claims due to any direct, indirect, incidental, special, consequential  or punitive damages arising from the use of this Website and/or any link from this Website that lead to business discontinuance, loss of data, costs related to replacement of products/goods, damage to goodwill or reputation and/or any consequences arising from the reliance on materials posted on this Website, regardless of foreseeability of the damages.

5.0 FORCE MAJEURE

5.1       SPRAY AND SHINE shall not be liable for any failure or delay in performing its obligations due to any acts beyond its reasonable control such as acts of God, war, pandemic, quarantine, accident, breakdown of web host, breakdown of internet service provider, breakdown of communication facilities, natural catastrophes, generalized lack of availability of raw materials or energy, national strikes, governmental act or omission, changes in laws or regulations.

6.0 INTELLECTUAL PROPERTY RIGHTS

6.1       All logos, trademarks, mascots, names (‘Intellectual Property’) available in this Website are the properties of SPRAY AND SHINE and are protected by copy rights laws around the world. All such rights are reserve by SPRAY AND SHINE. In no event, trademarks of SPRAY AND SHINE shall be used to associate any product or service that is not related or provided by SPRAY AND SHINE that would be highly likely to create confusion among customers or potential customers and/or question reputation and credibility of SPRAY AND SHINE.

7.0 WAIVER

7.1       Any delay or omission in exercising any clauses under the ToU by SPRAY AND SHINE or you shall not constitute as waiver of the said clause or impede/diminish any rights related to the said clause under the ToU.

8.0 SEVERABILITY

8.1       These terms of use, together with any amendments, policies and any additional agreements you may enter into with us in connection with the use of the website, shall constitute the entire agreement between you and us concerning the use of the website. In the event, any court of competent jurisdiction declares any clauses in the ToU to be null and void or unenforceable, such invalidity will not affect other clauses in the ToU. Remaining clauses or part of clause of the ToU shall remain in full force and effect.

9.0 RELATIONSHIP

9.1       The ToU in this Website does not constitute any employer-employee relationship or partnership unless Parties enter into a specific Contract with exclusively tailored terms.

10.0 THIRD PARTY RIGHTS

10.1     Rights under the ToU shall be available only to relevant parties. Individuals that are not parties to the ToU shall not under any circumstances enjoy the rights or privilege from the ToU .

11.0 JURISDICTION AND GOVERNING LAW

11.1     The courts in Hyderabad, Telangana, India will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.

11.2     These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of India.

12.0 MODIFICATION

12.1     The ToU and other relevant policies may subject to amendment from time to time, to ensure its conformity and no notice will be given pursuant to the changes made. The amended ToU will be posted in our Website and be enforced immediately. Continuous use of our Website by you amounts to acceptance of the amended ToU.
